The Purple House VACATION RENTAL AGREEMENT This Rental Agreement entered into on ____/____/_____ between Owner/Agent and Tenant in consideration of the monies received and mutual promises, contained herein, does hereby Rent the Property, 290 West Broadway, Jim Thorpe, PA 18229, under the following terms and conditions.
RENTAL TERM: START____/____/_____ _______p.m. END____/____/_____ _______p.m.
TERM AND CONDITIONS PAYMENTS Payments can be made by personal check, certified check, money order, cash or credit card. Personal checks are NOT accepted within twenty-one (21) days of Start date. The balanced due must be received by Owner/Agent Fifteen (15) days prior to Start date. Reservations made within thirty (30) days of Start date require payment in full. Payments are due within five (5) day of scheduled due date. Late payment could result in Cancellation at Owner/Agent sole discretion. FEE: A thirty ($30) dollar administrative handling fee will be charged for all returned checks and may result in loss of reservation. PROPERTY AND USE Property includes all surrounding areas, sidewalk, patio, and yard, contents, fixed and unfixed items. Tenant is responsible for bringing paper products, sheets, towels and food. Total occupants shall not exceed number specified above and never to exceed 8 overnight guests. Tenant will return property as it was found, clean and undamaged. Please report any damage or problems immediately so we may correct them for you and future tenants. Tenant agrees to: bag all trash, remove all trash/recycling to outside container, take trash/recycling to curb prior to Thursday 6am, wash and put away dishes, vacuum and/or sweep floors, return furniture to it original location, close and lock doors and windows, return keys. Tenant will make no alterations to Property including major rearranging of furniture and contents. CANCELLATIONS Request to cancel must be made in writing. To receive full refund cancellations must be made sixty (60) days prior rental start date. Owner/Agent will make every reasonable attempt to re-rent Property for cancellation period at the full price at which time Tenant will not be subject to Cancellation Fees. If Property is re-rented at a reduced rate the difference will be subject to Cancellation Fees. Cancellation Fees for cancellations made within: forty five (45) days is 10%, thirty (30) days is 30%, fifteen (15) days is 50%, and five (5) days is 75%. FEE: All cancellations made less than sixty (60) days are subject to an additional fifteen ($15) dollar administrative handling charge. SECURITY DEPOSIT Deposit will be returned to Tenant, without interest, and less any set off for damages to the Premises thirty (30) days from the End of this Agreement. Owner/Agent may retain all or a portion of security deposit for: late payment, cancellation, damage to Property, damage to contents of Property, default by Tenant of any Terms and Conditions herein, any cost incurred by Owner/Agent due to direct negligence of Tenant. In the event the amount of the security deposit is less than the amount due to Owner/Agent, Tenant promises to pay the difference to Owner/Agent upon demand. Tenant agrees to be responsible for any and all damage to the Property and its contents caused by themselves, their guest and their invitees. In the event Tenant has charged to a credit card either the security deposit or the rent due hereunder, Tenant authorizes Owner/Agent to charge to that credit card any amounts owed by Tenant to Owner/Agent pursuant to this paragraph. NON-DELIVERY OF PROPERTY In the event Owner/Agent cannot make the Property available to Tenant upon the start of the rental, through no fault of Owner/Agent or its agents (fire, flood, etc.), then Owner/Agents sole liability as a result of this unavailability is to provide a full refund of all monies paid under this Agreement and Tenant expressly acknowledges that in no event shall Owner/Agent be held liable for any special or consequential damages which result from this unavailability. At the Tenants discretion, the Owner/Agent will make every reasonable attempt to find a suitable substitute rental for Tenant.
TERMINATION If the Tenant or any member of their party violates any of the terms and conditions of this agreement, the Owner/Agent may terminate this rental with no refund of the used portions of the rents unless the property is able to be re-rented. LEGAL FEES Tenant agrees to be responsible for and to pay to any and all attorney’s fees and or costs incurred by Owner/Agent in enforcing her rights under this Agreement. The parties agree that the Courts of Carbon County Pennsylvania shall have jurisdiction and venue in any matter brought by either party and the parties waive venue and jurisdiction in any other court. WAIVER OF NOTICE Any notices required under this Agreement or the law shall be deemed effective upon Owner/Agent’s posting such notice on the Property and or depositing with the U.S. Mail, postage prepaid, addressed to Tenant’s last known address. Tenant waives all notice requirements that may be provided for under the Pennsylvania Owner/Agent-Tenant Act Tenant agrees that Owner/Agent may initiate an eviction action with the court immediately upon serving notice as provided for in this paragraph. RENTAL EXTENSION/ADDITIONAL NIGHTS If you would like to extend your stay please contact the Owner/Agent ASAP to check availability of additional nights. In the event Tenant fails to check-out as provided for in this Agreement or if Tenant fails to request from Owner/Agent permission for rental extension additional nights Tenant shall pay to Owner/Agent a holdover rent in the amount of two hundred and fifty dollars ($250.00) per additional night. Any additional nights are subject to the same terms and conditions herein. ALL RESERVATIONS MUST BE PAID IN FULL PRIOR TO CHECK IN. A RENTAL AGREEMENT MUST BE SIGNED PRIOR TO CHECK IN. Tenant is of eighteen (18) years of age or old and understands that this is a legally binding agreement when signed by both parties.
